Terms of Hire & Sale

  1. 'Us' / 'The Company' refers to BreastPump.ie and the parent company. 'The Hirer' means the person or persons (incorporated or otherwise) named in the booking form as hirer.

  2. It is the hirer’s responsibility to ensure that equipment is returned to us safely and in the same condition in which it was despatched. The risk to all equipment passes to the hirer on delivery of the equipment and reverts to the company upon safe receipt of the equipment.

  3. The hire period begins when the goods are despatched from us and ends on their recorded return to our office.

  4. When returning equipment by courier the hirer should get a receipt or tracking number and keep it for reference.

  5. The hirer agrees that our company shall not have any liability for any loss, injury (including fatal injury) or damage of any description what so ever which may be suffered or incurred by any person as a direct result of the use, malfunction of failure of the equipment or any part of it or the negligence of us, our service or agents. Any rights (if any) conferred on the hirer or liability on our company arising by virtue of sections 12 to 15 (inclusive) of the Sale of Goods Act 1893 (as amended by the Sale of Goods & Supply of Services Act 1980), are hereby confirmed and are not to be in any way restricted or excluded by these terms and conditions otherwise than in accordance with Section 55 of the Sale of Goods Act 1893.

  6. Geographical Limits – This product is only available to hire inside of the Republic of Ireland and may not be taken outside the country.

  7. Any damage caused to rental equipment due to misuse by the hirer renders the hirer liable for the repair/replacement of the equipment. In the case of water damage caused by water ingress to the machine on more than one occasion the hirer will be liable for the repair/replacement of the equipment and will be encouraged to use accessories & protocols to prevent the re-occurance.

  8. We reserve the right not to replace equipment which has been damaged excessively or has been replaced on more than one other occasion.

  9. Pumps must be retuned either in person or using a tracked courier service and not ordinary regular post.

Payments / Refunds

  1. All charges are payable in advance and can be paid online by credit or debit card.

  2. A fingerprint of the payment method (credit / debit card) is be stored for the duration of each rental automatically by Stripe. This fingerprint consists in an encrypted reference to the hirer's card and does not reveal the card number to us or any third party. This fingerprint is used to charge the card automatically for monthly renewal in the event of not returning the product within 7 days of the end of the end of the initial hire period, or if returning a damaged product.

  3. An initial payment covering the initial hire period, accessories, plus delivery (if applicable) is made at the time of delivery of the equipment.

  4. At the end of the initial hire period, the hirer must return the equipment within 7 days or pay in advance for future rental periods; failure to do so will make the hirer liable to a monthly charge (deducted each month in advance from the hirer's credit/debit card) at the current rate of hire for the product, until the equipment is returned. This liability of the hirer is in addition to the liability of the hirer to return equipment to our company, and will continue for as long as the equipment is not returned.

  5. In the event of the hirer not making any rental payment when due, either during the initial hire period or thereafter, our company will be entitled to seek either an immediate return of any equipment or the then current market value thereof with all outstanding rental charges until the equipment is either paid for or returned.

  6. We reserve the right not to sell our hire equipment and to refuse a renewal of the rental agreement.

  7. No refunds due to non-use of equipment can be made after dispatch of the equipment to the hirer.

We reserve the right to alter, add to or otherwise amend our conditions at any time.

All receipts are issued subject to clearance of funds.

Personal Data Collection

We comply with the Data Protection Acts 1988 and 2003, General Data Protection Regulation (GDPR) and all Irish and EU regulations in relation to all personal data obtained from users. We will not disclose, sell, rent or loan any personal data given by our customers to anyone. Personal information such as email addresses and financial information are collected in order to process the business relationship with the user. This information may also be used to contact the customer if necessary.

Right of Access

The company operates a policy of transparency. Customers have a right to access the personal data held on them. In addition, a customer may request to have their data erased, or corrected if inaccurate.

Security

We aim to provide a secure website and has measures in place to protect the loss, misuse and alteration of the information under its control. We take reasonable measures to protect your personal information from unauthorised access through the use of encryption and network firewalls on our website.

To ensure the security of your credit card details we use the Stripe credit and debit card payment processing system. Stripe is a secure payment system certified and approved by Irish banks (AIB, Bank of Ireland, etc).

This website uses cookies to keep track of your shopping cart and to make your experience easier by saving your preferences.

Your IP address will be logged by our server when you visit pages on our website. This IP address is used to help identify you and your shopping cart and to gather broad demographic information. It may also be used to help diagnose problems with our server and to administer our website.
